Between 2 and 3 % of the population of the world has an intellectual disability. Many persons with intellectual disabilities are restricted in their legal capacity. They have a legal guardian who takes some or all decisions for them. The UNCRPD confirms the right to full legal capacity in Article 12. To implement this right substitute decision-making should be abandoned in favour of supported decision making systems that assist persons in taking decisions in an autonomous way.
